Damage to mailbox

Our ex tenant left the flat 8 months ago. We had given him several months notice to redirect his mail and he had access to the mailbox in this period. At the end of January 2023, we padlocked the box. The box is attached firmly to the exterior of the property.

The box was then broken into several times since January but we had no CCTV evidence. At the end of May, he broke into the mailbox for the flat.
This time, we caught him at 4:30am on the recently installed CCTV. We provided the CCTV to the police - absolutely no doubt who it was. After a protracted time (policeman went on holiday to use his leave) the tenant was approached by the police this week (the wheels of injustice turn slowly!).

The tenant's view is that as he constructed the mail box when he was in residence, it is HIS box. Strangely the police seem to side with him!

His box... that might have been the case while he was in residence, but now the tenancy has come to an end it is YOUR box and he has inflicted criminal damage on it.
You may need to visit the police and make the point, perhaps Clitheroe can provide some case law.

His box... that might have been the case while he was in residence, but now the tenancy has come to an end it is YOUR box and he has inflicted criminal damage on it.
