Inheritance Tax - Family Maintenance, etc.

#210047

Postby JeffW55 » March 25th, 2019, 10:26 am

Hello,
My cunning plan to pass on some wealth IHT-free has come unravelled by its success and I would like to explore other avenues. There is a certain amount of reluctance from my grandchildren's parents for them to get substantial amounts from Junior ISAs when they are 18 in case they spend it unwisely. So I was looking for alternatives.

I see that gifts to a child in full time education for family maintenance/living costs are allowed tax-free: So can I give reasonable amounts IHT-free to my grandchildren whilst they go through university? Maybe it's only my children that would qualify (where were those surplus assets when they were 18!)?

A couple of them currently attend private schools (ages 9, 14): would contributing to their fees be IHT-free?

Other simple possibilities?

Jeff

HMRC's view is here in their Inheritance Tax Manual:

Dispositions for maintenance of the transferor's family: maintenance of other people's children
https://www.gov.uk/hmrc-internal-manual ... /ihtm04176

So, no, not merely your own children (who are most likely now too old).

The section commences here if of interest:

I should have added, in respect of University, that page includes:

Once a child has attained eighteen and is undergoing full-time education or training, IHTA84/S11 (2) applies only if

before attaining 18
the child was in the care of the transferor ‘for substantial periods’.

Best to study the entirety.
