So it seems the Treasury was pushing RBS into treating its customers unfairly, and this was not prevented by the FCA. Even though the FCA says "treating customers fairly is one of our priorities".

Bywaters was discussed in the link to Channel 4 News, which reported that they are not eligible for compensation under the new RBS/GRG redress scheme, because they are too "successful". So "successful" seems have replaced "sophisticated" in the redress scheme for IRHP mis-selling, as a criterion for exclusion from the scheme.

My complaint has been turned down because "these are not the findings of the FCA". So I have complained to the Complaints Commissioner.

Channel 4 News Siobhan Kennedy said "In response to questions for this report, the FCA raised the specter that they might never publish it." At least we can expect another summary: "The FCA is committed to publishing a further summary of the Promontory report as soon as possible."

For the FCA to say they will publish another summary of the Promontory report implies they have misgivings about the present summary. They also seem to have misgivings about the report itself, since they have postponed publication so many times. Also Mazars seem to have misgivings about the report, since they apparently no longer want to be an author. They are not mentioned as an author in the summary press release, and recently elsewhere.

My complaint to the Complaints Commissioner has been accepted. This is expected to take up to eight weeks, and I am promised news how it is progressing in four weeks.

In my complaint to the FCA, I commented on each of the eight statements, with the reply:

"As the further summary has not yet been published, I am not able to comment in detail on your specific points, because that would necessitate the disclosure of confidential information received by the FCA from the skilled person."

Oh dear! I seem to have a moving target. The FCA say they are going to have a new summary of the Promontory (formerly Promontory and Mazars) report. Perhaps this is an example of looking at something changing what you are looking at. Heisenberg would have approved.

The FCA is joining in RBS lies: GRG was not a profit centre, we did not engineer defaults, all SMEs transferred to GRG were in financial difficulties,
etc.

According to FCA: "The Report is a very comprehensive document and provides a detailed description of the work undertaken and contextual background of the market and the way that GRG operated at the time." So the FCA is saying: "We have this interesting document. But we are not publishing it. You will have to make do with various summaries we will be issuing from time to time, when we get round to it." This is taking the mickey.

It is unacceptable behaviour for the FCA to publish a summary of its report which hugely contradicts the Tomlinson Report, and then not publish its report. How can we be sure the summary is accurate? It might be total cobblers.

The FCA are coming under pressure from all directions, such as the TSC, to publish their s 166 report. Someone should make a FoI request to see it. I would do so myself, except that I am already making a FoI request to the BBC. They should not be allowed to keep making feeble excuses why they do not publish, having promised to publish when they received the report in 2016.

There seems to be a hopeless situation re the publication of the s 166 report. The problem is that if the skilled  person received   confidential information from RBS, they are not able to publish the report (under Section 348) without permission of RBS, because it contains confidential information. 

"RBS provided Promontory during the course of the review with 323 gigabytes of data (approximately 1.5 million physical pages and 270,000 emails)."                        

I was not even able to obtain a proper reply from the FCA  to  my complaint

It seems clear that the FCA has to have the permission of RBS to publish the s 166 report. But I don't know whether this is a problem. We have to wait for the response to the TSC request for publication.

Until then, the FCA’s statements had suggested that it would be published. I wonder whether we would be awaiting publication if the report cleared RBS’ name? "
